TERMS OF SERVICE

1. WHO WE ARE
This website, sunpotion.com, is operated by Sun Potion, LLC, 9905 S Pennsylvania Ave, Ste A, Oklahoma City, OK 73159, United States ("Sun Potion", "we", "us", "our"). By using this website or buying from us, you agree to these Terms of Service ("Terms") and to the policies linked in them, including our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree, please do not use the website.

Our store runs on Shopify. Subscriptions are managed through Recharge. Your use of those services is also subject to their terms.

2. ELIGIBILITY AND ACCOUNTS
You must be at least 18 years old, or the age of majority where you live, to buy from us. If you create an account, you are responsible for keeping your login details secure and for activity on your account. Please keep your contact, shipping and payment details accurate and up to date.

3. OUR PRODUCTS
Our products are foods, herbs and botanicals. Product descriptions, serving suggestions and articles on this website are for general information only. They are not medical advice and are not a substitute for advice from a qualified healthcare professional.

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease.

Talk to your healthcare provider before use if you are pregnant or nursing, take medication, or have a medical condition. Read the full ingredient list before use and do not use a product if you are sensitive or allergic to any ingredient. Keep out of reach of children. Store products as directed on the label.

We make every effort to show products, colors and packaging accurately, but screens vary and packaging may change. Natural products can vary slightly in color, taste and texture from batch to batch.

4. ORDERS, PRICING AND AVAILABILITY
All prices are in US dollars unless shown otherwise. Prices, products and availability can change without notice. Placing an order is an offer to buy. We may accept or decline any order, limit quantities per person, household or order, and cancel an order after it is placed, for example because of a pricing or description error, stock problem, suspected fraud or suspected resale. If we cancel an order you have paid for, we will refund you in full.

Taxes are calculated at checkout.

5. RESALE AND WHOLESALE
Retail purchases on this website are for personal use. Buying for resale requires a Sun Potion wholesale account. Retailers and practitioners can apply through our wholesale program (see our Contact page) or email order@sunpotion.com. We may cancel orders that appear to be placed for resale outside the wholesale program.

6. DISCOUNT CODES AND PROMOTIONS
Unless an offer says otherwise:
- Only one discount code can be used per order.
- Codes have no cash value, cannot be exchanged for cash and cannot be applied to past orders.
- Welcome and first-order codes are for new customers and can be used once.
- Codes are for personal use and may not be sold, shared publicly or posted on coupon sites.
- Automatic offers (for example, product pairings) apply only as described on the offer.
We may change or end any promotion at any time and may cancel orders that use codes obtained or used in breach of these rules.

7. SUBSCRIPTIONS (SUBSCRIBE & SAVE)
Some products can be bought as a subscription. When you subscribe:
- You authorize us to charge your payment method on file automatically at the delivery frequency you chose (for example, every 30 days) until you cancel. Each charge is at the subscription price shown at checkout, plus any applicable shipping and taxes.
- The subscription discount, frequency and price are shown before you check out. If a price or subscription discount changes, we will notify you before your next charge.
- You can skip, reschedule, change or cancel your subscription at any time before your next scheduled charge date. Sign in to your account and manage your subscription, or email order@sunpotion.com. Cancelling stops future charges. Charges already processed are handled under our Refund Policy.
- If a payment fails, we may retry the charge or pause the subscription.
- We may pause or end a subscription if a product is discontinued or unavailable, and we will let you know.
Subscriptions are not available on kits and sets unless stated on the product page.

8. SHIPPING, TITLE AND RISK
Shipping options, delivery times and our free-shipping offer are set out in our Shipping Policy. Free standard shipping applies to US orders of $150 or more after discounts and is not available on international orders or wholesale accounts. International orders may be subject to customs fees, duties and import taxes, which are the customer's responsibility. Title and risk of loss pass to you when your order is handed to the carrier. We will still help with lost or damaged packages as described in our Shipping Policy.

9. RETURNS AND REFUNDS
Returns and refunds are governed by our Refund Policy.

10. EMAIL AND TEXT MESSAGES
If you sign up for our emails or texts, you agree to receive marketing messages from Sun Potion at the email address or phone number you provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe from texts or HELP for help. You can unsubscribe from emails at any time using the link in any email. See our Privacy Policy for how we handle your information.

11. REVIEWS, COMMENTS AND SUBMISSIONS
If you post a review, comment, photo or other content, or send us ideas or feedback, you confirm that it is your own, honest and lawful, and you give us a non-exclusive, royalty-free, worldwide license to use, reproduce, edit and publish it in connection with our business. You must not post content that is false, misleading, unlawful, abusive or infringing, or that makes medical claims about our products. We may remove any content at our discretion. We are not required to keep submissions confidential or to pay for them.

12. INTELLECTUAL PROPERTY
Everything on this website, including text, photos, graphics, logos, product names and design, belongs to Sun Potion or its licensors and is protected by law. You may not copy, reproduce or use it for commercial purposes without our written permission.

13. ACCEPTABLE USE
You agree not to use this website to break any law; to infringe anyone's rights; to submit false information; to upload viruses or harmful code; to scrape, crawl or collect data from the website without permission; to interfere with its security or operation; or to harass or harm anyone. We may suspend or end your access if you do.

14. DISCLAIMERS AND LIMITATION OF LIABILITY
The website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise the website will be uninterrupted or error-free.

To the fullest extent permitted by law, Sun Potion, LLC and its owners, employees, agents, suppliers and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the website or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow these limits, so some may not apply to you.

15. INDEMNITY
You agree to indemnify and hold harmless Sun Potion, LLC and its owners, employees and agents from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

16. THIRD-PARTY LINKS AND SERVICES
Our website may link to or use third-party websites and services. We are not responsible for their content, products or practices. Please review their terms and privacy policies.

17. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the website will be brought in the state or federal courts located in Oklahoma County, Oklahoma, and you consent to their jurisdiction. Before filing any claim, please contact us at order@sunpotion.com so we can try to resolve it informally.

18. CHANGES TO THESE TERMS
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Changes apply to orders placed after the update. Your continued use of the website after an update means you accept the updated Terms.

19. GENERAL
If any part of these Terms is found to be unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms and the policies they reference are the entire agreement between you and us about your use of the website and replace any earlier versions.
